Terms of Service — Elegrates

These Terms of Service govern the use of Elegrates, a service owned and operated by sole proprietor Jovani Patino (“we”, “us”, “our”). By accessing or using our website, booking pages, or services, you agree to these terms.
1. Services Provided
Elegrates provides marketing and automation services for HVAC companies, including but not limited to:
AI caller setup and operation
Automated follow-up systems
HVAC lead generation campaigns
Facebook/Meta ads management
CRM setup and integration
Appointment booking systems
Marketing consulting
We may update or expand our services at any time.
2. No Guaranteed Results
While our systems are designed to increase booked jobs and improve follow-up, we do not guarantee results, including:
Specific lead volume
Specific number of booked appointments
Revenue increases
Ad performance results
Your success depends on factors outside our control such as:
Your market
Competition
Call answering
Job pricing
Sales ability
Seasonality
Ad budget
You acknowledge that no guarantees are being made.
3. Payments, Plans, and Billing
By purchasing our services, you agree to:
3.1 Upfront Fees
If your package includes a 90-day upfront payment (e.g., $2,499), this payment is due in full and is non-refundable.
3.2 Monthly Fees
After the initial period, services continue month-to-month at your agreed rate (e.g., $1,299/month) unless canceled.
3.3 Lead Generation Ad Spend
If you choose to run paid ads, the client is responsible for all ad spend directly with Facebook/Meta or other platforms.
3.4 No Refunds
Due to the nature of digital services, setup work, and software provisioning, all payments are final and non-refundable.
3.5 Failed Payments
If a payment fails, access to all systems—including AI caller, workflows, phone numbers, and automated follow-up—may be paused until payment is resolved.
4. Client Responsibilities
To ensure the program works, you agree to:
Provide accurate business information
Respond to customer inquiries generated by our system
Honor appointments booked by our AI Caller
Fund ad campaigns on time
Maintain your availability for scheduled appointments
Follow local laws and regulations in your area
We are not responsible for lost opportunities resulting from lack of follow-up on your end.
5. Use of AI Systems & Technology
All of the following remain the property of Elegrates:
AI Caller workflows
Automations & pipelines
Phone numbers used for calling/texting
CRM setup
Scripts and training data
Marketing funnels
Creative assets used in ads
Appointment booking systems
Call routing logic
You receive access, not ownership.
If you cancel or violate these terms:
The system will be deactivated
Access to AI Caller and workflows will stop
Phone numbers may be disconnected or reassigned
Automation, follow-up, and booking will cease
This protects our proprietary technology.
6. Cancellation Policy
After the initial 90-day period (if applicable), services move to a month-to-month plan.
To cancel:

Cancellations take effect at the end of the current billing cycle
No prorated refunds will be given
Upon cancellation:
AI Caller stops working
Automations are turned off
Access to systems and phone numbers is removed
7. Limitation of Liability
You agree that Elegrates is not liable for:
Lost profits
Missed calls
Missed opportunities
Ad performance fluctuations
Incorrect lead information
Damages resulting from reliance on our services
Any indirect, incidental, or consequential damages
Our maximum liability is limited to the amount you paid us in the last 30 days.
8. Changes to Terms
We may update these Terms at any time.
Updates will be posted here with a new “Last Updated” date.
Continued use of our services after updates means you accept the new Terms.
